Steady Sunday — Terms & Conditions

1. Definitions

Event — Steady Sunday, a single in-person small-group session delivered by Georgia Carter operating as Club Steady (“Club Steady”, “we”, “us”).

Attendee — the individual who books a ticket to the Event (“you”).

Venue — the gym premises at which the Event is held, as confirmed at booking.

2. Booking and Payment

2.1 A place at the Event is confirmed only once full payment has been received.

2.2 The Event has a maximum capacity of 12 attendees. Bookings are accepted on a first-paid, first-confirmed basis.

2.3 Ticket prices are as listed at the time of booking. All fees are inclusive of GST unless stated otherwise.

3. Cancellations and Refunds

3.1 Attendees may cancel and receive a full refund up to [X days] before the Event date.

3.2 Cancellations made within [X days] of the Event are non-refundable, but the ticket may be transferred to another person with prior written notice to Club Steady.

3.3 If Club Steady cancels the Event for any reason (including venue unavailability, insufficient bookings, illness, or force majeure), attendees will be offered a full refund or a place at a rescheduled date, at their choice.

3.4 No refund is provided for non-attendance on the day where the Attendee has not given prior notice of cancellation.

4. Health, Safety, and Risk Acknowledgement

4.1 The Attendee acknowledges that:

  1. participation in the Event involves physical exercise, including the use of gym equipment and free weights, and carries inherent risks including but not limited to injury, strain, or, in rare cases, more serious harm;

  2. the Event is not medical advice, treatment, or diagnosis, and is not a substitute for professional medical advice;

  3. it is the Attendee’s sole responsibility to seek appropriate medical advice regarding any pre-existing condition, injury, or concern before attending;

  4. the Attendee should consult a qualified medical professional before participating if they have any health condition that may be affected by physical exercise.

4.2 The Attendee warrants that they are in good health and have disclosed to Club Steady, prior to the Event, any condition that may affect their ability to safely participate.

4.3 The Attendee agrees to participate at their own discretion, to follow all instructions given by the facilitator, and to stop and notify the facilitator immediately if they feel unwell, unsafe, or experience pain during the session.

4.4 The Attendee must not attend the Event while under the influence of drugs or alcohol.

5. Release and Indemnity

5.1 To the fullest extent permitted by law, the Attendee releases Club Steady, its facilitator, staff, and the Venue from all liability for any claim, loss, injury, or damage arising out of or in connection with participation in the Event, except to the extent caused by the negligent act or omission of Club Steady.

5.2 The Attendee indemnifies Club Steady against any loss, damage, cost, or expense arising from the Attendee’s breach of these Terms, failure to disclose a relevant health condition, or their own act or omission during the Event.

5.3 Nothing in this clause excludes any right or remedy that cannot be excluded under the Australian Consumer Law.

6. Code of Conduct

The Attendee agrees to:

  1. treat the facilitator, Venue staff, and other attendees with respect;

  2. refrain from any conduct that is offensive, threatening, discriminatory, or otherwise inappropriate;

  3. follow any reasonable direction given by the facilitator for the safety and smooth running of the session.

Club Steady reserves the right to remove any attendee from the Event, without refund, for a serious breach of this code.

7. Photography and Marketing

7.1 Photos or video may be taken during the Event for promotional and marketing purposes.

7.2 Attendees who do not wish to be photographed or filmed should notify the facilitator in writing before the Event, or on arrival. Club Steady will take reasonable steps to honour such requests.

7.3 Attendees may withdraw consent to any specific image or footage already captured by notifying Club Steady in writing.

8. Liability

8.1 To the extent permitted by law, Club Steady’s total liability arising out of or in connection with the Event is limited to the amount paid by the Attendee for their ticket.

8.2 Club Steady is not liable for any indirect or consequential loss.

9. Privacy

Personal information collected at booking (including any health information disclosed) is handled in accordance with Club Steady’s Privacy Policy, available at clubsteady.com/privacy-policy.

10. General

10.1 Force majeure — Club Steady is not liable for failure to deliver the Event due to events beyond its reasonable control.

10.2 Severability — if any clause is found unenforceable, the remaining clauses continue in full force.

10.3 Governing law — these Terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.

10.4 Entire agreement — these Terms constitute the entire agreement between the parties in relation to the Event and supersede any prior representations.
